Terms of Service and End User License Agreement

These Terms govern your access to and use of DrivIQ, including automotive diagnostic tools, AI-generated explanations, AR vehicle assistance, quote analysis, parts lookup, subscriptions, reports, and related services.

1. Agreement to Terms

These Terms of Service and End User License Agreement (collectively, the "Terms") are a legally binding agreement between you and R.E. Labs LLC, doing business as DrivIQ, governing your access to and use of the DrivIQ mobile application, websites, reports, content, subscriptions, artificial intelligence features, augmented reality features, diagnostic tools, quote analysis, parts lookup, and related services (collectively, the "Services").

By downloading, installing, accessing, purchasing, subscribing to, or using the Services, you agree to these Terms and to any additional terms presented in the Services. If you use the Services on behalf of a company or organization, you represent that you have authority to bind that organization, and "you" includes that organization.

If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility and Accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services. If you are under the age of majority, you may use the Services only with involvement and consent of a parent or legal guardian who agrees to these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current. You must notify us promptly of any unauthorized account use or suspected security incident.

3. App License and EULA

Subject to your compliance with these Terms, DrivIQ grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the DrivIQ app on devices you own or control, solely for your personal or internal business use and only as permitted by these Terms and applicable app store rules.

The Services are licensed, not sold. DrivIQ and its licensors retain all rights, title, and interest in and to the Services, including software, source code, object code, interfaces, designs, databases, reports, text, graphics, trademarks, trade names, and other intellectual property.

You may not copy, modify, translate, adapt, reverse engineer, decompile, disassemble, attempt to derive source code from, rent, lease, sell, sublicense, distribute, or create derivative works of the Services, except to the extent such restrictions are prohibited by applicable law.

4. Apple App Store Terms

If you download DrivIQ from the Apple App Store, you acknowledge and agree that these Terms are between you and DrivIQ, not Apple. Apple is not responsible for the Services or their content, maintenance, support, warranties, claims, or compliance matters, except as required by applicable law.

Your use of the app must comply with the Apple Media Services Terms and any applicable App Store Usage Rules. Apple and its subsidiaries are third-party beneficiaries of the provisions in these Terms that apply to Apple-distributed apps and may enforce those provisions against you.

If we do not provide a custom EULA in App Store Connect for a given version or territory, Apple's standard Licensed Application End User License Agreement may apply in addition to these Terms to the extent required by Apple.

5. Services Description

DrivIQ is an automotive information and decision-support application. Depending on features available to you, the Services may help users manage vehicles, connect to compatible OBD-II Bluetooth devices, read diagnostic trouble codes, interpret readiness monitor status, explain diagnostic information, analyze repair quotes, generate reports, provide AI-powered automotive explanations, support AR vehicle assistance, locate common vehicle parts, research parts, estimate fair repair ranges, and store vehicle-related information.

The Services are intended to support education, organization, preparation, and communication. They are not a substitute for professional inspection, diagnosis, repair, maintenance, safety judgment, manufacturer instructions, recall notices, official service information, or applicable laws and regulations.

6. Automotive Safety Disclaimer

DrivIQ does not repair vehicles and does not provide professional mechanical, engineering, safety, legal, insurance, financial, or emissions compliance advice. Any information generated by the Services is for informational and educational purposes only.

Vehicles can be dangerous. Improper inspection, maintenance, repair, lifting, driving, modification, electrical work, fluid handling, emissions work, battery work, or use of tools can cause property damage, injury, or death. Always follow the vehicle manufacturer's instructions, safety warnings, service manuals, and applicable laws. Use qualified professionals for repairs, inspections, towing decisions, safety-critical work, emissions compliance, and diagnostic confirmation.

Do not use the Services while driving or in any manner that distracts you, impairs safe operation of a vehicle, violates traffic laws, or creates unsafe conditions. Pull over safely and comply with all laws before interacting with the app.

If you believe a vehicle is unsafe, smells of fuel, is overheating, has brake problems, steering problems, electrical smoke, battery damage, fire risk, active fluid leaks, airbag issues, or any other urgent condition, stop using the vehicle if safe to do so and contact a qualified professional, emergency service, roadside assistance, or the vehicle manufacturer as appropriate.

7. AI, AR, OBD, Pricing, and Parts Limitations

7.1 AI-generated content

AI-generated explanations, summaries, recommendations, reports, and responses may be inaccurate, incomplete, outdated, overconfident, or not applicable to your exact vehicle or situation. AI output may omit relevant facts, misinterpret user input, misunderstand images, or provide generalized information. You are responsible for independently verifying all information before relying on it.

7.2 OBD and diagnostic data

OBD-II data depends on vehicle compatibility, scanner compatibility, connection quality, vehicle condition, supported protocols, manufacturer behavior, and user operation. Codes, freeze frame data, readiness monitors, VIN data, live data, and parsed values may be unavailable, incomplete, delayed, inaccurate, or misinterpreted. Clearing codes does not repair the underlying problem and may reset readiness monitors or affect emissions testing.

7.3 AR and camera guidance

AR, camera, vision, photo, and voice guidance may fail to identify parts, may identify the wrong part, may be affected by lighting, camera angle, vehicle configuration, modifications, obstructions, or image quality, and may not reflect your exact vehicle. Do not place yourself, others, or property at risk to capture images or follow AR guidance. Do not perform repairs unless you are qualified and have verified the procedure with authoritative sources.

7.4 Parts lookup and fitment

Parts information, fitment guidance, part numbers, retailer listings, prices, availability, shipping, OEM references, and compatibility notes may be incomplete, outdated, wrong, or based on third-party data. Always verify fitment by VIN, manufacturer information, seller information, and a qualified professional before purchasing or installing parts.

7.5 Repair pricing and quote analysis

Repair price ranges, labor estimates, quote analysis, fairness ratings, shop suggestions, negotiation notes, and report outputs are estimates and decision-support information only. Actual prices vary based on location, vehicle condition, shop rates, diagnostic time, parts quality, taxes, fees, availability, warranty coverage, and other factors. DrivIQ does not guarantee savings, pricing accuracy, shop quality, repair outcomes, or estimate acceptance.

8. User Content and Vehicle Data

You may submit, upload, store, or transmit information through the Services, including vehicle information, VINs, mileage, diagnostic data, photos, videos, audio, repair quotes, documents, notes, chat messages, reports, and service history ("User Content"). You represent that you have all rights and permissions needed to provide User Content and that your User Content does not violate law or third-party rights.

You retain ownership of your User Content. You grant DrivIQ a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, process, analyze, transmit, display, create reports from, and otherwise use User Content as necessary to provide, maintain, secure, support, and improve the Services, comply with law, enforce these Terms, and develop aggregated or de-identified insights.

You are responsible for reviewing User Content before submitting it. Do not submit content that includes information you do not have permission to share, sensitive personal information not requested by the Services, illegal content, confidential third-party information, or content that may endanger any person.

9. Subscriptions, Purchases, and Refunds

Some features may require payment, an active subscription, in-app purchase, promotional access, or team access. Paid features may include AI Mechanic, Fair Price, Smart Scan, advanced live data, AR Vehicle Assist, Parts Lookup, multi-vehicle garage, saved reports, and other premium features.

When purchases or subscriptions are offered through the Apple App Store, billing, renewal, cancellation, and refund handling are administered by Apple under Apple's terms. Subscriptions may automatically renew unless canceled before the end of the then-current billing period through your Apple account settings. Deleting the app does not cancel a subscription.

Prices, included features, trials, promotional access, usage limits, and availability may change as permitted by applicable law and app store rules. We may add, remove, modify, throttle, or limit features, including AI, AR, and data-intensive services, to manage cost, abuse, safety, reliability, or legal compliance.

Except where required by law or app store policy, payments are non-refundable, and we do not provide credits, refunds, or prorated refunds for partially used periods, unused features, account termination, or user error.

10. Acceptable Use

You agree not to:

  • Use the Services for unlawful, unsafe, fraudulent, harmful, or abusive purposes.
  • Use the Services while driving or in a way that distracts from safe vehicle operation.
  • Rely on the Services as the sole basis for safety-critical, repair, towing, emissions, insurance, legal, or financial decisions.
  • Upload content that is illegal, infringing, misleading, defamatory, invasive of privacy, or harmful.
  • Attempt to bypass paywalls, subscriptions, usage limits, authentication, security, or access controls.
  • Scrape, harvest, copy, or bulk export data except through features we provide.
  • Reverse engineer, interfere with, overload, probe, scan, or disrupt the Services.
  • Use automated systems, bots, or scripts without our written permission.
  • Misrepresent outputs as professional certification, official manufacturer guidance, or guaranteed repair instructions.
  • Use the Services to develop competing products or train models without our written permission.

11. Third-Party Services

The Services may rely on or link to third-party services, including Apple, Firebase/Google services, AI providers, maps, retailers, parts marketplaces, OBD hardware, payment processors, repair shops, websites, and other data sources. Third-party services are not controlled by DrivIQ and may have their own terms, privacy policies, fees, availability, and limitations.

DrivIQ is not responsible for third-party products, services, data, prices, listings, repairs, advice, warranties, availability, or actions. Links or references do not imply endorsement.

12. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect information. Please review the Privacy Policy carefully. If these Terms conflict with the Privacy Policy regarding privacy practices, the Privacy Policy controls for that issue.

13. Intellectual Property

DrivIQ, the DrivIQ name, logos, designs, software, interfaces, reports, templates, content, features, databases, algorithms, and other materials are owned by DrivIQ or its licensors and are protected by intellectual property and other laws. No rights are granted except as expressly stated in these Terms.

If you provide feedback, ideas, suggestions, bug reports, or feature requests, you grant DrivIQ a perpetual, irrevocable, worldwide, royalty-free right to use them without restriction or compensation.

14. Suspension and Termination

We may suspend, limit, or terminate your access to the Services at any time if we believe you violated these Terms, created risk or legal exposure, misused the Services, failed to pay, abused AI or data services, compromised security, or if continued access is no longer commercially, technically, or legally feasible.

You may stop using the Services at any time. Termination does not automatically cancel App Store subscriptions; you must manage subscriptions through Apple account settings where applicable. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, arbitration, indemnity, and payment obligations.

15. Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." DRIVIQ DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RELIABILITY.

DRIVIQ DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, COMPLETE, CURRENT, COMPATIBLE WITH YOUR VEHICLE OR HARDWARE, OR THAT ANY OUTPUT WILL IDENTIFY, DIAGNOSE, PRICE, OR RESOLVE A VEHICLE ISSUE.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVIQ AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOST DATA; LOSS OF GOODWILL; VEHICLE DAMAGE; WRONG PART PURCHASES; REPAIR COSTS; TOWING COSTS; SHOP DISPUTES; PERSONAL INJURY; PROPERTY DAMAGE; OR DAMAGES ARISING FROM RELIANCE ON THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIVIQ'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DRIVIQ FOR THE SERVICES IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability is limited to the maximum extent permitted by law.

17. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless DrivIQ and its owners, officers, employees, contractors, affiliates, licensors, service providers, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Services, User Content, violation of these Terms, violation of law, unsafe conduct, vehicle work, third-party disputes, or infringement of third-party rights.

18. Arbitration and Class-Action Waiver

Please read this section carefully. It affects how disputes are resolved. To the maximum extent permitted by law, you and DrivIQ agree to resolve disputes through binding individual arbitration rather than in court, except for disputes that qualify for small claims court or claims seeking injunctive relief for intellectual property misuse or unauthorized access.

Before filing arbitration, the party bringing a claim must send written notice describing the dispute and requested relief. The parties will attempt in good faith to resolve the dispute informally for 30 days after notice is received.

If unresolved, disputes will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, unless another forum is required by applicable law. Arbitration will be conducted in Los Angeles County, California, unless remote, written, or local proceedings are required by applicable consumer arbitration rules.

You and DrivIQ waive the right to a jury trial and agree that disputes must be brought only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated, private attorney general, or representative proceeding. If this class-action waiver is found unenforceable for a particular claim, that claim must proceed in court and not arbitration.

Nothing in this section prevents either party from seeking emergency injunctive relief in court or from reporting concerns to a regulator or law enforcement agency.

19. Miscellaneous

Governing law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where consumer protection laws require otherwise.

Changes. We may update these Terms from time to time. The updated version will be indicated by a revised effective date. Continued use of the Services after changes become effective means you accept the updated Terms.

Export and sanctions. You may not use or export the Services in violation of U.S. export control, sanctions, or other applicable laws. You represent that you are not located in a prohibited country and are not on a prohibited party list.

Severability. If any provision is found unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable if permitted by law.

No waiver. Failure to enforce a provision is not a waiver. No waiver is effective unless in writing.

Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, operation of law, or business transfer.

Entire agreement. These Terms, together with the Privacy Policy and any additional terms presented in the Services, are the entire agreement between you and DrivIQ regarding the Services.
